“Starting May 14, 2022, pursuant to Utah Code 53G-10-103(1)(g) Sensitive Materials in Schools (enacted by House Bill 374 the 2022 Legislature) the following materials are deemed to have “no serious value to minors” in the school setting, and are thereby prohibited, under Utah Code 76-10-1227(2)(c) (adopted by reference in UCA 76-10-1235):

 

76-10-1227(2)(c) "A description or depiction of illicit sex or sexual immorality as defined in Subsection (1)(a)(i), (ii), or (iii) has no serious value for minors."

Expert testimony is not required:  76-10-1203

 

Therefore, materials that have a description or depiction of the following may not be allowed in the school setting:

• Human genitals in a state of sexual stimulation or arousal

• Acts of human masturbation

• Acts of sexual intercourse

• Sodomy

• Fondling or other erotic touching of human genitals or pubic region
